There are people rioting and protesting in the streets. A Target store was recently looted in Minneapolis. There is widespread discord throughout the nation over the death of George Floyd. Floyd was arrested for passing a counterfeit twenty-dollar bill and then held down for at least eight minutes, at which time he became unresponsive and moments later would be pronounced dead. Officer Derek Chauvin has been fired and is now being charged with 3rd-degree murder. But former U.S. Rep Trey Gowdy claims this is not enough. Gowdy feels Chauvin had ample time to react and should instead be charged with 1st-degree murder.
“It took too long. You know, murder one in Minnesota is premeditation with an intent to kill murder two is an intent to kill without the premeditation. Murder three is the doing of an inherently dangerous thing that results in someone’s death,” Gowdy stated. “So my question for the prosecutors and cops in Minnesota, Maria, is if you have a man with your knee on his neck and he is telling you, ‘you’re killing me, I cannot breathe. You’re killing me.’ How long’s it take for premeditation to manifest itself?”
“Nobody thinks these cops went to the scene with the intent to kill him. But at some point when you’re being warned that your conduct is taking someone’s life, Isn’t that premeditation? Isn’t that consciousness of guilt that you need to prove an intent to kill?” Gowdy asked. “So murder three is the easiest charge. But I was never a prosecutor that liked to go for the easiest thing. I think you need to do what fits the facts. And to me, I think is a murder one charge.”

Due to Chauvin’s behavior, Gowdy may very well have a point. Chauvin was not following protocol and looks to have accidentally killed Floyd. Now it is up to the courts to decide to what degree of intention that Chauvin had when he was pinning Floyd.
Too bad Gowdy was not as eager to punish evil doers while he was in office. Makes a good spot for commercials though.

To Mr. Gowdy – so apparently you think a charge should be upgraded based on what has happened in the community and now around the entire Republic? Last I checked criminal charges are based on statutory requirements, NOT based on community ‘outrage’. But then again I am not a liar er um lawyer. That officer (won’t name him – he don’t deserve any more publicity) should not be ‘sacrificed’ to appease those rioters. Besides that is NOT going to resolve all of the anger.
Sigh, just saw on the noon news the mantra that Mr. Floyd was murdered by that officer, even though the evidence at this point does not support that. I know, folks are gonna say but but but he knelt on that poor mans neck – never mind that the coroner has already determined that was the primary cause of death.

Was it premeditated or stupidity that caused the death of Floyd? The problem is that either way the riots wont stop because they are not about the death of Floyd. They started out as a protest but now they are nothing more than paid thugs paying more thugs to burn the nation’s liberal cities down. Unfortunately there are liberals promoting it like the Mayor marching with the rioters, Biden and his people bailing them out, the NYC mayor praising his daughter for getting arrested, the rep in DC calling for more, the ex-CIA agent calling for more, and on and on. Thing is, it is the liberal cities and states being burned down by liberal thugs being paid for by more liberals while liberal politicians stand back and do nothing. One little town had a back bone and it’s citizens armed themselves and protected their town. Seems the thugs are not afraid of the police but they are of angry business owners and the citizens who refuse to stand by and allow their towns to burn. Citizens are more likely to shoot their butts so that town was saved. Maybe that is what needs to be done. We, the law abiding citizens, take up arms and run these thugs out of our cities and states. Take back our nation from liberal violence and hatred.
